Special Needs

Usually my clients are more than happy to let me share the work I've done for them publicly, and under normal circumstances, I retain the rights to every commission for the purposes of advertising and additional sales. However, there are circumstances in which this may not be desirable. For those circumstances I offer special licensing for an additional fee.

All such deviations from my standard Terms of Service require an additional contract to ensure the interests of both parties are guaranteed and protected.

Privacy

Under normal circumstances, I retain the right to post my artwork in my galleries, social media, and other public venues, and sell prints of the commissioned work; posting commissions is my primary means of advertising and source of new customer intake. However, for an additional fee, I will refrain from posting the work in any of my galleries or working on it in any live venue. If you need this service, we’ll negotiate the fee during preparation of the invoice.

Sales Restriction

As mentioned, one of the rights I reserve under normal circumstances is the right to use the commission for sales and other commercial use in the future. For example, I may use the work in art books, or as a part of my streaming career. If this is not desirable, you may opt to pay a sales restriction fee to limit or remove my ability to use the work commercially. This fee will be valued based on the extent of that limitation.

Licensing and Release

My terms of service disallow any commissioned work from being used in a commercial environment. If you would like to use my work in a commercial manner—to make money in any way—we’ll determine whether you need licensing or a full release, and negotiate an appropriate fee.

Licensing

A basic licensing fee will permit you to use the work for commercial purposes, but I retain the rights to use the work for whatever I see fit, including marketing and sales. This license will generally be interminable unless we agree otherwise, and it will be valued at what I believe is fair based on the nature of the commercial use: designing a new logo for Nike would have a higher license fee than a small Twitch streamer selling merchandise using my designs.

Full or Limited Release

If you need complete control over the work once it is completed—for example, if you want to commission me to design characters for your video game and you need to ensure that you hold in perpetuity all of the rights to the artwork, character designs, and so forth—we can discuss a full release. With such a release, I’ll surrender some or all my rights to the artwork, as per our agreement, so that you can reserve the work as exclusively as you need to. Full release fees will generally be higher than a licensing fee to account for losing the artwork as a marketing and sales tool, and, as with a licensing fee, will be valued based on the nature of the use requiring release.
